HB 2350 - DD RHC federal compliance ¶

Section 1 ¶

Any time the department receives notice that a residential habilitation center is out of compliance with the centers for medicare and medicaid services conditions of participation, the secretary shall provide written notice within 10 days to each resident of the residential habilitation center and additional individuals as indicated in RCW 71A.10.060 of each of the following:

1. The initial statement of deficiencies or other determination of noncompliance, including the reason or reasons for the finding of noncompliance;

2. Establishment of any plan of correction for the facility; and

3. All subsequent determinations regarding the facility's return, or failure to return, to compliance, and any related federal enforcement action.
