HB 2002 - Public use of fentanyl, meth

Section 1

  1. It is unlawful for any person to knowingly or intentionally combust or exhale the smoke of a substance:

    1. The person knows or reasonably should know contains or is contaminated with fentanyl or methamphetamine, or their isomers, esters, ethers, salts, or salts of isomers, esters, or ethers; and

    2. While in a public space and within 10 feet of another person, or while inside an enclosed public space with another person.

  2. Except as provided in subsection (3) of this section, any person who violates this section is guilty of a gross misdemeanor.

  3. Any person who violates this section while in a public space and within 10 feet of another person under age 13, or while inside an enclosed public space with another person under age 13, is guilty of a class C felony.

  4. For the purposes of this section, "public space" includes, but is not limited to, a public conveyance, park, transit stop, hospital or other health care setting, or any other place open to the public.
